Plaster Portal Terms & Conditions
These terms and conditions ("Agreement") govern your use of the Plaster Portal website and online courses provided by North Black Partners, Inc., doing business as New Age Artisans ("Plaster Portal"). By accessing or using the Plaster Portal website or participating in our online courses, you agree to be bound by this Agreement.
1. Access and Use
1.1 Eligibility: To access and use the Plaster Portal website and online courses, you must be at least 18 years old or have the consent of a parent or legal guardian.
1.2 Account Creation: You may need to create an account to access certain features of the Plaster Portal. You are responsible for providing accurate and complete information during the account creation process.
1.3 Course Enrollment: By enrolling in a Plaster Portal online course, you agree to abide by the course-specific terms and conditions, including any prerequisites or requirements.
2. Intellectual Property
2.1 Ownership: All content provided on the Plaster Portal website, including but not limited to text, graphics, logos, images, videos, and course materials, is the property of North Black Partners, Inc. or its licensors and is protected by intellectual property laws.
2.2 Limited License: Plaster Portal grants you a limited, non-exclusive, non-transferable license to access and use the website and course materials for personal, non-commercial purposes only. You may not modify, distribute, reproduce, or sell any content from the Plaster Portal without prior written consent.
3. User Responsibilities
3.1 Prohibited Conduct: You agree not to engage in any conduct that violates applicable laws, infringes upon the rights of others, or disrupts the Plaster Portal community. This includes, but is not limited to, unauthorized access, harassment, or sharing of course materials without permission.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify Plaster Portal immediately of any unauthorized use or breach of security.
4. Limitation of Liability
4.1 Disclaimer: Plaster Portal provides the website and online courses on an "as is" basis without warranties of any kind. While we strive to provide accurate and up-to-date information, we do not guarantee the completeness, reliability, or accuracy of the content.
4.2 Indemnification: You agree to indemnify and hold harmless Plaster Portal, its affiliates, and their respective directors, officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising out of your use of the Plaster Portal website or participation in our online courses.
5. Governing Law
5.1 Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the state of Montana.
5.2 Dispute Resolution: Any disputes arising out of or in connection with this Agreement shall be resolved through good faith negotiations. If a resolution cannot be reached, the parties agree to submit the dispute to binding arbitration.
6. Modifications
6.1 Changes to Agreement: Plaster Portal reserves the right to modify or update this Agreement at any time. We will provide notice of any material changes through the Plaster Portal website or via email.
By accessing or using the Plaster Portal website or participating in our online courses after the effective date of any modifications, you agree to be bound by the updated Agreement.
Plaster Consult Terms and Conditions
Plaster Consultation Terms & Conditions
New Age Artisan’s Plaster Consultation Service is an offering which allows individuals that are conducting plaster work in their personal spaces to receive guidance and advice from New Age Artisans’ plasterers. After signing up, users will provide New Age Artisans with their goals for the finished look of their space and the square footage of the project and upload a description, measurements, and photos of the existing space to the online portal. New Age Artisans will then work with users to schedule online video calls. Users will receive five one-hour online video calls with a New Age Artisan plasterer.
Online Portal Access
Access to the online portal requires prior registration and payment for the Plaster Consultation Service. To enter the online portal, you will need a user ID and a password (your Login Credentials). Do not share your Login Credentials with any other person or allow any other person to access the online portal using your Login Credentials. You are provided with access to the online portal for your use only. Do not access the online portal for any purpose that is unlawful or prohibited by these Terms and Conditions.
The information provided on the online portal is provided on an “as is” basis. All information is accurate to the best of New Age Artisans’ knowledge and belief at the time of uploading, but New Age Artisans does not aim to predict future developments. North Black Partners, Inc., d/b/a/ New Age Artisans makes no representations that your access to the website, online portal, and Consultation Documentation will be uninterrupted, timely, or secure.
Intellectual Property
North Black Partners, Inc., d/b/a New Age Artisans, owns all intellectual property rights in the Plaster Consultation Service, the website, the online portal, and all Consultation Documentation.
“Consultation Documentation” shall include, but not be limited to: the plaster consultation workbook; instructional videos; supplementary instructional documents; pictures or drawings uploaded to the website or the online portal; and all other plaster consultation-related documentation and content.
As a user of the Plaster Consultation Service, you may access the website, online portal, and Consultation Documentation as part of the service. You may view the Consultation Documentation online and download or print it for personal use only. Through your use of the Plaster Consultation Service and/or use of the website, online portal, and Consultation Documentation, you agree not to:
- Modify, alter, copy, reproduce, publish, republish, create derivative works from, upload or post (with the exception of uploading or posting to the online portal), transmit, sell, resell, rent, sublicense, or distribute the Course Documentation in any manner;
- Remove or alter any copyright or trademark notices from the website, online portal, or any Consultation Documentation.
Limitation of Liability; Disclaimer of Warranties
To the maximum extent permitted by law, North Black Partners, Inc., d/b/a/ New Age Artisans makes no representations or warranties of any kind, express or implied. It expressly disclaims the implied warranty of merchantability and the implied warranty of fitness. There are no warranties that extend beyond the description on the face hereof.
The guidance and advice provided as part of the Plaster Consultation Service are based on and limited to the information that users provide to New Age Artisans plasterers, who are unable to observe, measure, or otherwise interact with the physical workspace.
Product and tool recommendations throughout the Plaster Consultation Service and Consultation Documentation are not intended to amount to any endorsement of or arrangement with any company, product, or tool on which you should rely. The recommendations are not intended to be relied upon, and users should not rely upon them, in making or refraining from making a specific purchase, sale, or other such decision. Users are advised and strongly encouraged to familiarize themselves with each tool and product and its specifications, use, and/or installation instructions before proceeding with any plastering activity. Issues with any individual product or tool should be brought to the attention of the manufacturer.
North Black Partners, Inc., d/b/a/ New Age Artisans accepts no liability for any failure to comply with these Terms and Conditions, the Consultation Documentation, or plasterer recommendations. Furthermore, it shall not be liable to you for any direct, indirect, economic, incidental, special, or consequential damages whatsoever arising out of or connected with your use of the Plaster Consultation Service or your use of any product or tool during your use of the Plaster Consultation Service.
North Black Partners, Inc., d/b/a/ New Age Artisans is not responsible for any interference with or damage to any device you use to access the Plaster Consultation Service, website, online portal, or Consultation Documentation arising from viruses, malicious computer code, or other forms of interference that may damage your devices.
Miscellaneous
Governing Law: These Terms and Conditions are to be governed and construed in accordance with the laws of the state of Montana.
Severability: If any provision of these Terms and Conditions is found to be invalid, the invalid provision shall be severable, and the remainder of the Terms and Conditions shall continue in full force and effect.
Interpretation: Headings are provided for convenience only. New Age Artisans and North Black Partners, Inc., d/b/a/ New Age Artisans are to be understood to refer to the same entity.
